By accessing or using our Website, purchasing a membership, downloading Content, or interacting with our materials, You agree to be bound by these Terms.

If You do not agree, please discontinue use of our Website immediately.

1. GENERAL USE OF THE WEBSITE
You must be at least 18 years old and capable of forming a legally binding contract to use our Website or purchase our products.

By using this Website, You represent and warrant that You:

2. ACCOUNT REGISTRATION & SECURITY
To access certain areas—including the Élevae Membership library—You may be required to create an account.

You agree to:

-Keep your login credentials confidential
-Notify us immediately of unauthorized use
-Not share your login with any other person
-Shared, transferred, or “borrowed” accounts are strictly prohibited and grounds for account termination.

3. INTELLECTUAL PROPERTY OWNERSHIP
All photographs, videos, AI-generated content, graphics, copy, curated collections, digital assets, and Website materials (“Content”) are:

-Owned by Élevae Visuals LLC, or
-Exclusively licensed to Élevae Visuals for distribution

All Content is protected by copyright, trademark, and other intellectual property laws. Except as permitted under a valid Élevae membership or license, You may not:

-Copy
-Share
-Distribute
-Resell
-Modify
-Upload elsewhere
-Use in templates
-Create derivative stock libraries

Any unauthorized use violates these Terms and may result in legal action.

4. MEMBERSHIP LICENSE (STANDARD SUBSCRIBER LICENSE)
When you purchase an Élevae Membership, You receive a non-exclusive, non-transferable, limited-use license to use the Content during your active subscription.

A. Permitted Uses
You may use Content to:
-Promote and market your own business
-Use on your website, blog, email marketing, and organic social media
-Use in digital and paid advertising
-Use in presentations, PDFs, client proposals
-Use in printed marketing materials (up to 5,000 copies per image unless noted otherwise)

B. Prohibited Uses
You may NOT:
-Transfer, share, or give image files to clients
-Upload Élevae Content into Canva templates, website templates, or digital products
-Use Content in any product, template, or deliverable where the end user receives the image files
-Use Content in trademarks, logos, or trade dress
-Scrape, mass-download, or automate extraction of Content
-Use Content for obscene, defamatory, harmful, or unlawful purposes
-Upload Élevae images into AI tools that store, learn from, or retain user-uploaded content
-Use Élevae images to train, fine-tune, or develop any AI or machine learning model
-Resell or redistribute Content in any format
-Create derivative stock photography or digital asset libraries

Violation of any prohibited use may result in immediate license termination.

5. DESIGNER’S LICENSE
If You wish to use Élevae images in client projects, templates, digital products, or commercial deliverables, You must purchase a separate Designer’s License.

The Designer’s License:
-Grants expanded usage rights
-Allows providing specific image files to clients
-Allows use in templates for sale
-Has its own terms and limitations

In the event of conflict between these Terms and the Designer’s License Agreement, the Designer’s License governs.

Membership alone does NOT grant permission for client use or template use.

6. AI TECHNOLOGY (DISCLOSURE & USER RESTRICTIONS)

A. Company Use of AI
Our website and related materials may include the use of AI technologies, including but not limited to AI-generated text, graphics, images, and/or audio.

AI is used solely as a supporting tool, while all final decisions, creative direction, and approvals are made by human team members.

Where applicable, AI-generated images will be clearly labeled inside the membership gallery. We maintain copyright ownership over all AI-assisted or AI-generated content. We make no guarantee regarding the accuracy of third-party AI outputs.

B. User Restrictions Involving AI
Users may not, under any circumstances:
-Use any Élevae Content to train, fine-tune, or develop AI or machine learning models
-Upload Élevae Content into tools that store, learn from, or retain user content
-Create derivative AI datasets, styles, or models using Élevae Content
-Use Content to build or enhance competing stock photography, design, or AI-based libraries

Violations will result in immediate account and license termination.

7. SUBSCRIPTIONS, AUTO-RENEWAL, AND CANCELLATION

A. Automatic Renewal
Memberships automatically renew at the end of each billing cycle unless cancelled before the renewal date.

B. Billing Terms
By purchasing a subscription, You authorize recurring charges to your payment method.

C. No Refunds
All sales are final. No refunds or partial credits are issued for:
-Subscription renewals
-Mid-cycle cancellations
-Accidental purchases

D. Cancelling Your Subscription
Cancellations must be made through your Élevae Membership account settings. Your membership will remain active until the end of the paid billing period.

8. WEBSITE CONDUCT & PROHIBITED USES
You may not:
-Attempt to hack, disable, or disrupt the Website
-Scrape, crawl, or harvest Content or data
-Reverse engineer any part of the Website
-Misrepresent your identity or impersonate another user
-Post harmful, false, defamatory, or unlawful content

We reserve the right to investigate and take appropriate legal action.

9. THIRD-PARTY SERVICES
Élevae uses third-party providers for services such as:
-Payment processing
-Website hosting
-Email delivery
-SMS and mobile messaging
-Analytics

We are not responsible for the policies or actions of third-party services. Your use of third-party tools is governed by their respective terms.

10. DISCLAIMERS

We do not warrant that:

Our total liability shall not exceed the amount You paid to Élevae in the six months preceding the claim.

You agree to indemnify and hold Élevae harmless from any claims, damages, or expenses arising from:
-Your misuse of the Website
-Unauthorized use of Content
-Violation of these Terms
-Violation of intellectual property rights

13. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of the State of Florida.

Any disputes must be brought exclusively in a Florida court of competent jurisdiction, unless both parties agree to arbitration.
